Pupgrade is a force-free, positive-reinforcement dog-training app. It picks tonight's lesson, walks you through it, and tracks how your dog is coming along. These terms explain what you can expect from us and what we expect from you. Use Pupgrade and you agree to them.

1. Who we are

Pupgrade is a product of OYE Creations LLC ("we", "us", "Pupgrade"). These terms govern your use of pupgrade.app, pupgrade.dog, and the Pupgrade training and community apps (together, the "Service"). If anything here is unclear, reach us before you rely on it. See Contact below.

2. What the Service does

Pupgrade gives you training guidance: structured lessons, a sound toolkit, a schedule, progress tracking, and an optional community where you can share your dog's progress. Everything is built around positive reinforcement, never harsh or aversive methods. The guidance is educational, designed to help everyday owners train everyday dogs.

Pupgrade is not veterinary care and not a substitute for a certified professional. We are not your dog's vet, and we are not a substitute for a hands-on, in-person trainer or a credentialed animal behaviorist. See the safety note below.

3. Eligibility

You must be at least 18 years old to create a Pupgrade account and use the Service. By using it, you confirm you meet that requirement and that the information you give us is accurate.

4. Your account

You are responsible for the accuracy of your account details and for keeping your login secure. You are responsible for activity that happens under your account. Tell us promptly if you believe your account has been accessed without your permission.

5. Acceptable use

Pupgrade is a kind place for dogs and the people who love them. By using it you agree that you will not:

• Break the law or infringe anyone's rights.
• Use the Service to promote or document harsh, aversive, or abusive training, or any harm to an animal.
• Post content that is unlawful, hateful, harassing, or that violates someone else's privacy or intellectual property.
• Attempt to disrupt, overload, reverse-engineer, scrape, or gain unauthorized access to the Service.
• Claim a public profile name (a vanity slug) in bad faith, or impersonate another person, dog, breeder, or brand.

We may remove content and suspend or close accounts that abuse the Service or these terms.

6. AI coaching features

Some Pupgrade features use AI to give you coaching, including a training assistant and optional feedback on a training clip you choose to share. These use the Claude API from Anthropic. AI can be wrong, incomplete, or generic, and it works from limited context (your note plus, where available, a single still frame), not a full view of your dog. Treat AI suggestions as one helpful opinion, not a diagnosis or a guarantee. Our AI is built to stay force-free and to point you to a vet or a certified professional for medical or serious behavioral concerns; you should do the same.

7. Payments, billing, and refunds

Pupgrade has a free tier and paid options. Prices are shown before you buy. Payments are processed by Stripe; we never see or store your full card number.

• Pupgraded subscriptions (monthly or yearly) start with a free trial and then renew automatically at the price shown until you cancel. You can cancel anytime, and your access continues through the end of the period you have already paid for.
• Forever Home is a one-time purchase for lifetime access, not a subscription, so it does not renew.
• Refunds: if something went wrong on our end, contact us and we will make it right. Subscription fees already charged for a completed period are generally non-refundable, but we are reasonable people, so reach out.
• We may change prices going forward; a change never applies retroactively to a period you have already paid for.

If you ever buy Pupgrade through an app store, that store's billing terms (including its rules for renewals, cancellations, and refunds) also apply to that purchase, and you manage that subscription through the store.

8. Who owns what

Your content is yours. Your dog's profile, photos, notes, and training data belong to you. By posting to the community you give us permission to display that content within the Service so it works as intended. Our platform is ours. The Pupgrade software, lesson library, design, branding, sounds, and underlying tooling are owned by OYE Creations LLC and are not transferred to you. You may not copy or reuse them beyond normal use of the Service.

9. No guarantee of results

Every dog and every owner is different. We do not promise any particular result, timeline, or behavior change. Progress depends on your dog, your consistency, your environment, and factors outside our control. The Service is provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows.

10. Your dog, your responsibility

You know your dog; we do not. You are responsible for safely supervising your dog at all times, for choosing which guidance is appropriate, and for keeping yourself, your dog, other people, and other animals safe during any training. You assume the risk of training activities. If a lesson does not feel safe or right for your dog, stop and ask a vet or a qualified professional.

11. Limitation of liability

To the fullest extent permitted by law, OYE Creations LLC is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including any injury, loss, or outcome involving you, your dog, other people, or other animals. Where liability cannot be excluded, it is limited to the amount you paid us for the Service in the 12 months before the claim.

12. Suspension and termination

You can stop using Pupgrade and close your account at any time. We may suspend or end your access if you violate these terms or use the Service in a way that creates risk for us, for other members, or for any animal. Sections that by their nature should survive (ownership, disclaimers, assumption of risk, liability) survive termination.

13. Changes to these terms

We may update these terms as Pupgrade grows. If we make a meaningful change, we will update the date at the top and, where appropriate, notify account holders. Continued use after a change means you accept the updated terms.

14. Governing law

These terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-laws rules. Any dispute will be handled in the courts located in New Mexico, unless applicable law gives you the right to bring it elsewhere.
